1. Definitions
"MidiVPN" refers to the company operating this service, registered in Greater Paris, France.
"Infrastructure" refers to the dedicated hardware or virtual machine provided to you as part of your product.
"You" / "User" refers to the individual or legal entity that has purchased or registered for a MidiVPN product.
"Node" refers to your dedicated WireGuard® server — hardware or cloud — provisioned exclusively for your use.
2. Infrastructure Provider Model
MidiVPN operates as an infrastructure provider, not a traditional VPN service. When you purchase a MidiVPN product, you receive a dedicated private node that you administer. You are the administrator of your infrastructure.
This means:
- Your traffic does not pass through MidiVPN servers.
- You are responsible for the lawful use of your infrastructure.
- MidiVPN does not monitor, inspect, or log your VPN traffic.
- You have full administrative access to your node (Cloud VPN) or your hardware (hardware products).
3. Acceptable Use
You agree to use your MidiVPN infrastructure only for lawful purposes. The following uses are strictly prohibited:
- Any activity that violates applicable local, national, or international law.
- Distribution of malware, spam, or unsolicited communications.
- Attacks on third-party systems (DDoS, port scanning, intrusion attempts).
- Distribution of child sexual abuse material or any illegal content.
- Any activity that causes harm to MidiVPN infrastructure or other users.
MidiVPN reserves the right to suspend or terminate your service immediately and without notice if prohibited use is detected or reported.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You must notify MidiVPN immediately of any unauthorised access to your account. MidiVPN is not liable for losses resulting from unauthorised account access caused by your failure to secure your credentials.
5. Service Availability
MidiVPN targets 99.5% uptime for cloud infrastructure. Hardware products depend on your own internet connection and power supply — MidiVPN does not guarantee uptime for hardware deployed on your premises. Scheduled maintenance will be communicated in advance where possible.
6. Intellectual Property
MidiVPN's platform code is open source and available on GitHub under the applicable open-source licence. WireGuard® is a registered trademark of Jason A. Donenfeld. OpenWrt is a registered trademark of the OpenWrt Project. MidiVPN makes no claim of ownership over these third-party marks.
7. Limitation of Liability
To the maximum extent permitted by applicable law, MidiVPN shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. MidiVPN's total liability for any claim shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
8. Governing Law
These Terms are governed by French law. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection law in your country of residence provides otherwise.
9. Changes to These Terms
MidiVPN may update these Terms to reflect changes in our services or legal obligations. Continued use of the service after notification of changes constitutes acceptance of the updated Terms. Material changes will be communicated by email to registered users.
